Splošni pogoji poslovanja in uporabe spletne strani
Dobrodošli na spletni strani maraandart.com.
V nadaljevanju so zapisani pogoji poslovanja, ki urejajo uporabo spletne strani ter nakup izdelkov in storitev.
Z uporabo spletne strani potrjujete, da ste s pogoji seznanjeni in se z njimi strinjate.

1. Uporaba spletne strani
Vsebine na spletni strani so informativne narave. Trudimo se zagotavljati točne in aktualne podatke, vendar si pridržujemo pravico do sprememb brez predhodnega obvestila. Možnost tipkarskih napak ni izključena.
Fotografije izdelkov so lahko simbolične. Dekorativni dodatki, prikazani na fotografijah, niso vključeni v ponudbo, razen če je to izrecno navedeno.
Vsa besedila, fotografije in druge vsebine so avtorsko zaščitene. Njihova uporaba, kopiranje ali razmnoževanje je dovoljeno le s predhodnim pisnim soglasjem Mara & Art.
2. Registracija, vnos in varstvo podatkov
Ob registraciji oz. vnosu podatkov za namen nakupa uporabnik zagotavlja, da so posredovani podatki točni in resnični.
V primeru zlorabe ali kršitve pogojev si Mara & Art pridržuje pravico do omejitve ali onemogočitve dostopa do spletnih vsebin (vključno s tečaji in drugimi digitalnimi produkti), brez vračila kupnine.
Osebni podatki se obdelujejo izključno za namen izvajanja naročil, komunikacije s strankami, vodenja evidenc ter prilagajanja vsebin, skladno s Politiko zasebnosti.
Podatki se hranijo za čas trajanja registracije in se izbrišejo ob izbrisu uporabniškega računa.
Spletna stran uporablja piškotke za nemoteno delovanje, analizo uporabe in izboljšanje uporabniške izkušnje. Z uporabo strani soglašate z njihovo uporabo.
3. Sklenitev pogodbe
Prodajna pogodba med kupcem in podjetjem Mara & Art je sklenjena v trenutku, ko kupec odda naročilo. Pogodba je sklenjena v slovenskem jeziku.
4. Cene in plačilo
Vse cene so navedene v EUR in ne vključujejo stroškov dostave. Veljavne so cene v trenutku oddaje naročila.
Pridržujemo si pravico do spremembe cen brez predhodnega obvestila.
Način plačila
Plačilo je mogoče po predračunu (nakazilo na TRR):

Rok za plačilo je 3 delovne dni od prejema predračuna. Če plačilo ni izvedeno v navedenem roku, se šteje, da je kupec od naročila odstopil.
5. Zaloga in dobava
Če naročenega izdelka trenutno ni na zalogi, boste o tem pravočasno obveščeni skupaj s predvidenim rokom dobave. V primeru, da vam rok ne ustreza, lahko od naročila odstopite.
Naročila, ki so uspešno oddana in plačana, bodo odposlana predvidoma v roku 3–5 delovnih dni.
Dostavo na območju Slovenije izvaja Pošta Slovenije. Stroški pakiranja in dostave niso vključeni v ceno izdelkov.
V primeru poškodbe pošiljke vas prosimo, da nas o tem nemudoma obvestite na info@maraandart.com.
Elektronski produkti (printi ipd.) so dobavljeni izključno v digitalni obliki.
6. Odstop od pogodbe in vračila
Fizični izdelki
Potrošnik ima pravico, da v 14 dneh od prejema blaga odstopi od pogodbe brez navedbe razloga. O odstopu nas obvestite pisno na info@maraandart.com.
Izdelke je potrebno vrniti najkasneje v 14 dneh od obvestila o odstopu. Izdelki morajo biti nerabljeni, nepoškodovani in v originalni embalaži, iz pošiljke pa mora biti razvidna identifikacija naročila.
Stroške vračila nosi kupec. Pošiljk z odkupnino ne sprejemamo.
Vračilo kupnine izvedemo najkasneje v 14 dneh po prejemu vrnjenega blaga (ki ustreza zgoraj naštetim pogojem), na bančni račun, ki ga posreduje kupec.
Digitalni izdelki in izdelki po naročilu
Pri izdelkih, izdelanih po navodilih kupca ali prilagojenih njegovim osebnim potrebam, odstop od pogodbe ni mogoč.
Prav tako vračilo ni mogoče pri digitalnih vsebinah (printi in drugi elektronski produkti).
7. Stvarne napake
Če ima izdelek stvarno napako ali ste prejeli napačen izdelek, lahko svoje pravice uveljavljate skladno z veljavno zakonodajo.
O napaki nas obvestite v roku dveh mesecev od njenega odkritja in nam omogočite pregled izdelka. V primeru utemeljene reklamacije imate pravico do odprave napake, zamenjave izdelka, sorazmernega znižanja kupnine ali vračila kupnine. Stroške, povezane z uveljavljanjem stvarne napake, nosi prodajalec.
8. Omejitev odgovornosti
Kupec je dolžan z izdelki ravnati skrbno in v skladu z njihovim namenom. Prodajalec ne odgovarja za poškodbe, nastale zaradi nepravilne uporabe.
Prav tako ne odgovarjamo za morebitne motnje v delovanju spletne strani ali tehnične težave, ki bi lahko vplivale na dostop do vsebin.
9. Poslovanje s podjetji
Kadar kupec ni potrošnik v smislu veljavne zakonodaje, določbe o odstopu od pogodbe in stvarnih napakah ne veljajo. V teh primerih se uporabljajo splošna pravila Obligacijskega zakonika.
10. Veljavnost pogojev
Ti splošni pogoji veljajo od 01. 02. 2026 do preklica. Pridržujemo si pravico do sprememb brez predhodnega obvestila. Ob nakupu veljajo pogoji, objavljeni na spletni strani v trenutku oddaje naročila.

Product photographs are for illustrative purposes only. Decorative accessories shown in photographs are not included unless explicitly stated otherwise.

2. Registration and Personal Data
When registering or providing personal information for the purpose of placing an order, the customer confirms that all information provided is accurate and truthful.
Mara & Art reserves the right to restrict or terminate access to website content, including online courses and other digital products, without refund in the event of misuse or breach of these Terms and Conditions.
Personal data is processed solely for the purposes of fulfilling orders, communicating with customers, maintaining business records, and improving the user experience, in accordance with the Privacy Policy.
Personal data is stored for as long as the customer account remains active and is deleted once the account is removed.
This website uses cookies to ensure proper functionality, analyse website traffic, and improve the user experience. By using this website, you consent to the use of cookies.
3. Formation of the Contract
A sales contract between the customer and Mara & Art is concluded when the customer successfully places an order.
For live event illustrations separate agreement is signed between both parties, where all terms and conditions are specified.
4. Prices and Payment
All prices are displayed in euros (EUR) and exclude shipping costs unless stated otherwise. The price valid at the time the order is placed shall apply. International payments must be made in EUR. Client is responsible for any bank transfer fees and must ensure that the full invoiced amount is received by the illustrator. For international bank transfers, please select OUR option to ensure the full invoice amount is received.
Mara & Art reserves the right to change prices without prior notice, except where special agreement was signed (live illustrations).
Payment
Payment is accepted by bank transfer based on a pro forma invoice.

Payment must be received within three business days from the date the invoice is issued. If payment is not received within this period, the order will be considered cancelled by the customer.
5. Product Availability and Delivery
If a product is temporarily out of stock, you will be informed as soon as possible together with an estimated delivery time. If the proposed delivery date is not suitable, you may cancel your order.
Orders that have been successfully placed and paid for are usually dispatched within three to five business days.
Deliveries within Slovenia are carried out by Pošta Slovenije. Packaging and shipping costs are not included in the product price unless otherwise stated.
If your parcel arrives damaged, please contact us immediately at info@maraandart.com.
Digital products, including printable files and other downloadable content, are supplied exclusively in digital format.
6. Right of Withdrawal and Returns
Physical Products
Consumers have the right to withdraw from the purchase contract within 14 days of receiving the goods, without giving any reason.
To exercise your right of withdrawal, please notify us in writing at info@maraandart.com.
Returned products must be sent back within 14 days of notifying us of your withdrawal. Products must be unused, undamaged, and returned in their original packaging. The returned parcel must clearly identify the relevant order.
The customer is responsible for the cost of returning the goods. We do not accept cash-on-delivery (COD) returns.
Refunds will be processed within 14 days of receiving the returned goods, provided they meet the conditions set out above. Refunds will be made using the same payment method used for the original purchase, unless otherwise agreed with the customer.
Digital Products and Custom Orders
The right of withdrawal does not apply to products made to the customer’s specifications or clearly personalised to their individual requirements.
Digital products, including printable files and other downloadable content, are non-refundable once they have been delivered or made available for download.
7. Defective or Incorrect Products
If you receive a defective product or an incorrect item, you are entitled to exercise your rights in accordance with the applicable consumer protection legislation.
Please notify us of the defect within two months of discovering it and allow us to inspect the product.
If your claim is found to be valid, you are entitled to have the defect remedied, receive a replacement product, obtain a proportional price reduction, or receive a full refund, as provided by applicable law. Any costs associated with a valid claim will be borne by the seller.
8. Limitation of Liability
Customers are responsible for using products with reasonable care and only for their intended purpose. Mara & Art accepts no liability for any damage resulting from improper use of its products.
We are also not liable for temporary interruptions to the operation of this website or for technical issues that may affect access to its content.
9. Business Customers
Where the customer is not considered a consumer under applicable legislation, the provisions relating to the right of withdrawal and consumer remedies for defective goods shall not apply. In such cases, the contractual relationship shall be governed by the applicable provisions of Slovenian contract law.
10. Validity of These Terms
These Terms and Conditions are effective from 1 February 2026 until amended or replaced.
Mara & Art reserves the right to amend these Terms and Conditions at any time without prior notice. The version of the Terms and Conditions published on the website at the time an order is placed shall apply to that purchase.
